How to Get an EIN for a Florida LLC: The Free IRS Route, the Delays, and When to Hand It Off
October 8, 2026 · 8 min read
You can get an EIN for a Florida LLC yourself, for free, in about ten minutes on the IRS website — and if you meet the requirements, the number is issued instantly on screen. There is no filing fee, no state charge, and no legitimate reason anyone should pay hundreds of dollars for it. The IRS Internet EIN assistant is open Monday through Friday, roughly 7:00 a.m. to 10:00 p.m. Eastern, and it is the only official online channel.
So why does a paid option exist at all? Because the free process has three real friction points: it requires a U.S. Social Security Number or ITIN for the responsible party, it punishes small data-entry errors in ways that are genuinely annoying to unwind, and it has to be sequenced correctly against your Sunbiz filing. If none of those apply to you, stop reading after the walkthrough below and go do it yourself. If one of them does, the $49 route stops being a convenience fee and starts being a reasonable trade.
Does your Florida LLC actually need an EIN?
A single-member Florida LLC with no employees is treated as a “disregarded entity” by the IRS, which means it can technically use the owner’s SSN for federal tax purposes. In practice, almost every Florida LLC ends up needing an EIN anyway. Here’s when it’s genuinely required versus merely strongly advisable:
| Situation | EIN required? | Notes |
|---|---|---|
| Multi-member LLC (two or more owners) | Yes | Files a partnership return (Form 1065) by default |
| LLC with any employee | Yes | Needed for federal payroll deposits and Form 941 |
| Electing S-corp or C-corp tax treatment | Yes | Form 2553 and Form 8832 both require an EIN |
| Filing federal excise taxes (fuel, certain retail) | Yes | — |
| Opening a business bank account | Practically yes | Nearly every Florida bank and credit union asks for one, even for single-member LLCs |
| Single-member LLC, no employees, no bank account | No | Rare in practice |
| Hiring 1099 contractors | Practically yes | Lets you put the EIN on W-9s instead of your SSN |
| Registering with the Florida Department of Revenue | Practically yes | The DR-1 business tax application asks for your FEIN |
That last row matters more in Florida than people expect. Florida has no state personal income tax and no general state business license, so there is no statewide “register your business” step after Sunbiz. But if you sell taxable goods or services, rent commercial property, or pay wages, you’ll register with the Florida Department of Revenue for sales and use tax and/or reemployment tax — and that application wants your federal EIN. Getting the EIN first keeps that process from stalling.
The privacy angle is also real. Without an EIN, your SSN goes on every W-9 you hand to a client. For a freelancer or contractor sending out a dozen W-9s a year, that alone justifies the ten minutes.
Get the LLC approved on Sunbiz first
This is the sequencing mistake that causes the most cleanup work, so it goes before the walkthrough.
Form the LLC with the Florida Division of Corporations before you apply for the EIN. The IRS application asks for your legal entity name, the state where the entity was organized, and the date it was formed. If you guess at those fields and your Articles of Organization then come back with a different name — because your first choice was too close to an existing registration, or because you adjusted the designator — you now have an EIN attached to a business that doesn’t exist. The IRS will not simply swap the name on an EIN issued under a mismatch; you’re writing a letter to Cincinnati and waiting.
Florida online filings through Sunbiz typically process in 3–5 business days, and the state offers no paid expedite for LLC formations — there is no fee you can pay to jump the queue. Budget for that window. The filing itself is $125: a $100 filing fee plus the mandatory $25 registered agent designation. (If you want to see how the EIN, registered agent, and first annual report stack up against that, the Florida LLC cost calculator breaks out every line.)
Once Sunbiz shows your LLC as Active and issues a document number, you have everything the IRS application needs. Note that the Sunbiz document number and your EIN are two completely different identifiers — the document number is a state record locator and has no federal use whatsoever.
The free IRS process, step by step
Before you start, have this ready:
- The exact legal name of the LLC as it appears on the Sunbiz record, including “LLC” or “L.L.C.” punctuation
- The Florida street address (a PO Box is not accepted as the principal business address, though you can supply a separate mailing address)
- The responsible party’s full legal name and SSN or ITIN
- The number of LLC members
- The date the LLC was formed (the Sunbiz effective/filed date)
- Your best estimate of the highest number of employees you expect in the next 12 months — if zero, say zero
- The closing month of your accounting year (almost always December)
- A one-line description of what the business does
Then:
- Go to IRS.gov and search for “Apply for an Employer Identification Number (EIN) Online.” Do not use a search ad; several paid lookalike sites charge for the same free form.
- Select Limited Liability Company as the entity type, then enter the number of members and select Florida as the state where the LLC is located.
- Read the screen that follows carefully. For a single-member LLC, the IRS explains it will be treated as a disregarded entity by default. For two or more members, a partnership. This is informational — you are not electing anything here. S-corp election is a separate Form 2553 filed later.
- Identify the responsible party. For most Florida LLCs this is the owner, or the member with the most control over the entity’s funds and assets. It must be a natural person, not another entity, and the IRS asks whether that individual is a member of the LLC.
- Enter the Florida address and the business start date.
- Answer the activity questions honestly — particularly the ones about employees, excise taxes, gambling, and alcohol/tobacco/firearms. Over-answering here creates filing obligations you don’t have.
- Choose how to receive the confirmation letter. Select the option to view and download the CP 575 notice as a PDF immediately. Save it in two places.
The EIN appears on screen the moment you submit. You can use it for a bank account right away, though it can take up to two weeks to fully propagate through IRS systems for things like electronic payments.
One hard limit worth knowing: the IRS issues one EIN per responsible party per day. If you’re setting up three LLCs for three different ventures, that’s three days.
Mistakes that delay approval or cause problems later
Applying before Sunbiz approval. Covered above. The single most expensive mistake in time.
Selecting the wrong entity type. The dropdown has “Corporations,” “Partnerships,” and “Limited Liability Company” as separate choices. Choosing Corporation for your LLC because you plan to elect S-corp status later is wrong — select LLC, then file Form 2553 separately. Fixing the entity classification on an issued EIN means correspondence with the IRS.
Saying you’ll have employees when you won’t. If you enter an expected employee count above zero, the IRS opens employment tax filing requirements and will start mailing notices about missing Forms 941. Enter zero if you genuinely have no payroll plans in the next year. You can add payroll later.
Naming the wrong responsible party. The responsible party should be the person who actually controls the entity. Listing a passive investor, an accountant, or a parent company creates a mismatch that surfaces during bank KYC review and requires a Form 8822-B to correct.
Letting the session time out. The IRS assistant expires after about 15 minutes of inactivity and does not save partial progress. Gather your information before you start.
Applying twice. If you don’t see a confirmation, don’t resubmit. Duplicate EINs for one entity are a real headache — the IRS won’t delete the extra one, it can only be closed out by written request.
Assuming you can reprint the CP 575. You can’t. The original confirmation notice is issued once. If you lose it, you request a 147C letter by calling the IRS Business & Specialty Tax Line, and they’ll mail or fax it. Most banks accept a 147C, but it costs you a phone hold and a few days.
If the responsible party has no SSN or ITIN
The online assistant simply won’t work. This is the most common reason a Florida LLC owner can’t self-file, and Florida has a lot of these owners — foreign nationals forming LLCs for e-commerce, real estate holding, or consulting, often paired with a Florida registered agent.
Your options:
- Fax Form SS-4 to the IRS. Processing typically runs about four business days if you include a return fax number.
- Mail Form SS-4. Four weeks or more is normal.
- Call the IRS International EIN line at +1-267-941-1099 (not toll-free), available Monday through Friday during posted hours. An agent can issue the EIN during the call if the form is completed and the caller is authorized.
On line 7b of Form SS-4, a foreign responsible party writes “Foreign” rather than a taxpayer ID number. The form must be signed by the responsible party or by someone with a valid Form 2848 power of attorney or Form 8821 authorization on file.
When the $49 filed-for-you route makes sense
Here is the honest version. Paying for an EIN makes sense in four situations:
- The responsible party has no SSN or ITIN. You’re on the fax or phone track, Form SS-4 has to be filled out correctly the first time, and a mistake costs weeks rather than minutes.
- You’re forming multiple entities. The one-per-day limit and repeated data entry add up.
- You want the sequencing handled. Formation, EIN, and operating agreement in one pass, with the EIN filed only after Sunbiz confirms the exact legal name.
- You’ve already made a mistake. Wrong entity type, duplicate EIN, or a name mismatch — the correction path is worth having someone walk.
If you have a U.S. SSN, one LLC, and an approved Sunbiz record in front of you, the free route is genuinely a ten-minute task and you should just do it.
For everyone else, our $49 EIN filing service handles the application and returns the confirmation. It’s also bundled into the Pro plan ($254.99 including the $125 state fee), alongside same-day Sunbiz submission and a personalized operating agreement — which is the version most multi-member LLCs end up wanting anyway, since the operating agreement is what overrides the default rules in the Florida Revised Limited Liability Company Act (Chapter 605, Florida Statutes) on things like voting, distributions, and member exit.
What to do once you have the number
- Open the business bank account. Bring the CP 575, your Articles of Organization from Sunbiz, and your operating agreement. Commingling funds is the fastest way to undermine the liability separation you paid for.
- Register with the Florida Department of Revenue if you’ll collect sales tax or pay wages. The DR-1 application is online and free.
- Check local requirements. Florida has no general state business license, but many counties and municipalities require a local business tax receipt, and some trades require state-level professional licensing. This varies — check with your county tax collector and your city, and verify any professional board requirements for your field.
- Put your EIN on your annual report. The Florida annual report form asks for your FEI/EIN number. It’s due each year by May 1, costs $138.75 for an LLC, and the filing window opens January 1. Miss May 1 and a $400 late fee applies with no waiver; stay unfiled past the fourth Friday of September and the state administratively dissolves the LLC. If you’d rather not track it, our annual report service handles the filing at $199/yr.
The free Florida LLC startup checklist puts these in order if you want to work through them one at a time.
Frequently Asked Questions
How long does it take to get an EIN for a Florida LLC? If the responsible party has an SSN or ITIN and uses the IRS online assistant during operating hours, the number is issued immediately on screen. Fax applications using Form SS-4 take roughly four business days, and mailed applications take four weeks or more.
Can I get an EIN before my Florida LLC is approved on Sunbiz? You can, but you shouldn’t. If the name on your Articles of Organization ends up differing from what you entered with the IRS, you’ll need to correct it by mail — wait the 3–5 business days for Sunbiz processing instead.
Does a single-member Florida LLC need an EIN? Not strictly, if it has no employees and no excise tax obligations — the IRS treats it as a disregarded entity reportable on your personal return. But nearly every Florida bank requires one to open a business account, and having one keeps your SSN off client W-9s.
I lost my EIN confirmation letter. Can I get another copy? The original CP 575 is issued only once and cannot be reprinted. Call the IRS Business & Specialty Tax Line and request a 147C letter, which serves the same purpose and is accepted by most banks and lenders.
Does getting an EIN create any Florida state tax obligation? No. An EIN is federal, and Florida has no state personal income tax. Separate state registration with the Florida Department of Revenue is only needed if you collect sales tax, pay wages, or owe certain other state taxes.
